Ask The City – Are Handicapped Spaces In Private Lots Enforceable?

In private parking lots (such as lots at apartment complexes) is it legal to park in clearly marked handicapped parking spots without the proper permit? If this is not legal, can and will the responding officer issue a citation?

The City's Response:

Handicapped parking is the only City parking ordinance that can be enforced on private property.  The penalties for parking in handicapped spots are also higher.  Police don’t generally patrol private lots, but if complaints are received and substantiated, parking citations for parking in a handicapped space without a permit can be issued.  Please call Dispatch at 721-2526 to initiate a complaint.
