On December 4, around 3:30 pm, Laramie Police Officers made a traffic stop in the 1500 block of Snowy Range Road for a minor traffic violation.

Further investigation resulted in 47-year-old Brian E. Baldivia being arrested for Driving While Under the Influence, making this his fourth offense, as well as being charged with three traffic violations and possession of a controlled substance.

Wyoming Statute 31-5-233(e) states no person shall drive or have actual physical control of any vehicle within this state, under the influence of alcohol or under the influence of a controlled substance to a degree that renders him incapable of safely driving.

A fourth offense resulting in a conviction within ten years, he shall be guilty of a felony and fined not more than ten thousand dollars, punished by imprisonment for not more than seven years, or both.

These are merely accusations, and the Defendant is innocent until proven guilty.
