Transient Facing Felony After Spitting in Cheyenne Cop’s Face

A 26-year-old transient is facing a handful of charges, including a felony aggravated assault charge, after reportedly spitting in a Cheyenne police officer's face.

According to a booking sheet, Fabian Manuel Hernandez was arrested at the Jack R. Spiker Parking Facility located at 307 W. 17th St. at 10:18 Tuesday morning.

Police say Hernandez had several of his belongings scattered on the east side of the parking garage but refused to pick them up and leave the area.

Hernandez also reportedly refused to comply with numerous verbal commands from officers to stand up, and when they grabbed his arms to stand him up, he spit saliva and food in one of their faces.

Police say when they moved Hernandez face down on the ground, he continued to resist and pulled his arms away so he could not be handcuffed, and once handcuffed, continued to tense and was verbally combative.

Hernandez was subsequently placed in "The Wrap" (a temporary restraining device) and a department-issued spit sock.

Police say Hernandez had methamphetamine pipes with residue and an open container of alcohol in his possession.

Hernandez was booked into the Laramie County Detention Center on charges of possession of an open container, interference with a peace officer - no injury, criminal trespass - signs, paraphernalia - delivery, and aggravated assault on a peace officer.

Hernandez is scheduled to make his initial appearance in Laramie County Circuit Court tomorrow, Sept. 21, at 2 p.m.
